Judge Throws Out Cases Against James Comey and Letitia James: Prosecutor’s Authority Ruled Invalid
In a stunning legal development, the federal cases against former FBI Director James Comey và New York Attorney General Letitia James have been dismissed—not because of the evidence, but because the prosecutor who brought the charges was never legally authorized to do so.

Interim Prosecutor Lacked Lawful Authority
According to CNN’s Katelyn Polantz, the ruling came from Judge Cameron Currie of South Carolina, who reviewed arguments from both sides and determined that Lindsey Halligan, the interim U.S. Attorney installed in the Eastern District of Virginia, had no legitimate authority to sign or present the indictments.

Halligan was appointed directly by the Trump administration, but she was never confirmed by the U.S. Senate—a constitutional requirement for the role.
“The Attorney General’s attempt to install Ms. Halligan as interim U.S. Attorney…was invalid,” Judge Currie wrote in her 26-page opinion, concluding that everything Halligan did—including the Comey and James indictments—was legally void.
Dismissal Without Prejudice
Judge Currie dismissed the indictments without prejudice, meaning prosecutors could revive the charges—but only if a properly appointed U.S. Attorney takes the case back to a grand jury.

As of now, however, the indictments are effectively dead.
White House Pressure and Political Motivations
CNN’s Kristen Holmes reported that the Trump White House was deeply involved in pushing for these prosecutions.
Trump personally urged Attorney General Pam Bondi to appoint Halligan.
Halligan had never appeared before a grand jury prior to the Comey case.
When the existing U.S. Attorney resisted, he was reportedly forced out.
The dismissals undercut one of the administration’s major efforts to pursue Trump’s political adversaries, raising broader questions about politicization inside the Justice Department.

Echoes of the Trump Classified Documents Case
Kaitlan Collins noted a striking parallel: Judge Currie cited the same legal reasoning used in U.S. v. Trump, the case in Florida where Judge Aileen Cannon dismissed Trump’s classified documents indictment, ruling that special counsel Jack Smith was improperly appointed.
In both situations, the courts concluded that prosecutors lacked lawful authority—rendering all actions taken in those cases invalid.

What Happens Next?
The dismissals occurred at the district court level, meaning:
The Justice Department may appeal.
The cases could be revived by a different prosecutor.
The legal fight could stretch on for months—or even years.
For now, both Comey and Letitia James are cleared, not by vindication on the facts, but by the collapse of the prosecutions themselves.
