Senator Josh Hawley did not simply attend a hearing; he delivered a stinging indictment of his Democratic colleagues, accusing them of orchestrating a four-year lie regarding the mental fitness of former President Joe Biden. Armed with the findings of the Department of Justice (DOJ) Special Counsel’s report, Hawley asserted that the Democratic Party willfully and dangerously protected power over truth, creating a “constitutional crisis” and demonstrating they are a party that “cannot be trusted to tell the truth.”


 

The Hypocrisy of The “Stone Wall”

 

Hawley’s core accusation stems from the profound, undeniable contradiction between public statements and a key DOJ conclusion:

The Statements: Hawley pointed to a string of Democratic leaders—including the former Vice President and several Senators and Congressmen—who publicly and repeatedly assured the nation that Biden was “sharp, focused, formidable, and effective.” These were assurances given in late 2024, at a time when questions about the President’s age and acuity were already prominent.
The DOJ Conclusion: Hawley slammed the fact that the DOJ, after interviewing Biden regarding his illegal retention of classified documents (kept in places like his garage and freezer), concluded that he “could not form the requisite mental state to stand trial.”

Hawley correctly framed this contradiction as undeniable proof that Democrats “lied to us for four years,” a lie that enabled a crisis and, in his view, constitutes a “form of elder abuse” by continuing to run a candidate for the highest office who the DOJ deemed unable to recall basic details necessary for a criminal defense. The Legal Standard: Citing a witness’s testimony regarding the Office of Legal Counsel (OLC) opinion, Hawley affirmed the crucial legal standard: the autopen (a mechanical signature) can only be used when the President “specifically directs it” and the action is “under his direct authority.” Furthermore, a record of this personal consent should exist in the policy paper flow, typically through the Staff Secretary’s office.
The Demand: Hawley pointed out the political gravity of the pardons and clemencies granted by the Biden White House, which he broadly characterized as benefiting “murderers, drug dealers, [and] child rapists.” He then turned the issue into a “binary question” that demands a simple, documentable answer: Did Joe Biden actually authorize the use of the autopen for these actions?
The Ultimatum: Hawley issued a direct call to the former President and his staff: “Release the documents. Show us the documents where the president authorized the use of the pen for every single pardon and clemency and stay application. Let’s see it.” He made it clear that if the documents are not released voluntarily, they must be subpoenaed, as the American people deserve to know who was truly making the decisions in the White House.
